SECTION 1. PROPERTY REZONED
Section titled “SECTION 1. PROPERTY REZONED”Section 23.01.185 of the Zoning Code of Sacramento County, which incorporates Comprehensive Zoning Plan 356/212, is amended to change the real property shown on Exhibit “A” to the RE-2 (PD) Estate (Planned Development) Zone. Exhibit “A” is attached hereto and incorporated herein and made a part of this ordinance.
SECTION 2. INCORPORATION WITHIN ZONING CODE
Section titled “SECTION 2. INCORPORATION WITHIN ZONING CODE”Chapter 1, Article 3, of the Zoning Code of Sacramento County, Ordinance No. 1111, as amended, is hereby amended by adding thereto Section 23.01.349, which shall read as follows:

SECTION 3. EXHIBITS INCORPORATED
Section titled “SECTION 3. EXHIBITS INCORPORATED”Exhibit 1, described generally in this section and attached to this ordinance is incorporated herein and made a part of this ordinance to regulate the property described in Exhibit “A”. The exhibits are on file in the office of the Clerk of the Board of Supervisors and are a part of this ordinance as if fully set forth herein.

SECTION 4. PERMITTED USES
Section titled “SECTION 4. PERMITTED USES”The following uses shall be permitted within the Planned Development:
- One (1) single family detached dwelling on each lot.
- Accessory buildings and uses.
- Foster homes not to exceed six (6) children including children of the foster family.
- Signs shall be as permitted by Section 23.07.021 (i, j, k) of the Sacramento County Zoning Code. Real estate signs shall have a maximum area of five (5) square feet.
SECTION 5. BUILDING REQUIREMENTS
Section titled “SECTION 5. BUILDING REQUIREMENTS”All buildings, principal and accessory, shall be constructed within the areas shown and designated as “Residential Building Sites” on Exhibit 1. Such areas shall be considered the “buildable area” or “buildable portions of the lot”. The design, configuration and layout of such buildings shall be accomplished so as to minimize the removal or damage of trees.
SECTION 6. GRADING
Section titled “SECTION 6. GRADING”Except for Lots 36 through 39 inclusive, as shown on Exhibit 1, grading of individual lots is not permitted except for minor grading necessary to provide driveway and garage slabs, yard landscaping, and that required to ensure adequate drainage. This requirement shall not preclude the installation of private swimming pools.
SECTION 7. STREETS
Section titled “SECTION 7. STREETS”All streets indicated on Exhibit 1 shall be offered for dedication as public streets and shall be constructed in conformance with the standards set forth in the County Improvement Standards adopted by Resolution No. 73-495 of the Board of Supervisors for Class “B” streets as defined therein.
SECTION 8.
Section titled “SECTION 8.”The Declaration of Covenants, Conditions, and Restrictions shall be approved by the County Counsel prior to the issuance of any building permits for dwelling units.
SECTION 9. FINDINGS
Section titled “SECTION 9. FINDINGS”During the public hearings on this ordinance, the Planning Commission and the Board of Supervisors determined that:

- The proposed development is compatible with existing and proposed land uses in the surrounding area.
- The exceptions to the standard requirements of the Sacramento County Code, Ordinance No. 1111, as amended, are justified by the design of the development.
- The arrangements of dwellings is justified by a larger and more usable open space.
- There is adequate assurance that all public improvements will be installed at the scheduled times as required by the Public Works Department.
- There is adequate assurance that the development schedule will be met.
- The existing or proposed utility services are adequate for the uses and population densities proposed.
SECTION 10. VARIANCES
Section titled “SECTION 10. VARIANCES”[DELETED 07-30-1981]
SECTION 11. VIOLATIONS
Section titled “SECTION 11. VIOLATIONS”Violation of the provisions of this ordinance or exhibits made part of this ordinance shall be deemed a violation of the Sacramento County Zoning Code, Ordinance No. 1111, as amended.

Section titled “EXHIBIT “A””All of Lot 2, Fair Oaks Tract, the official plat of which is recorded in the office of the Recorder of Sacramento County in Book 3 of maps map No. 24.
