Section 23.01.138 of the Zoning Code of Sacramento County, which incorporates Comprehensive Zoning Plan Unit No. 300/152, is amended to change the zoning on the real property shown on Exhibit “A” to the AC (PD) Zone. Exhibit “A” is attached hereto and incorporated herein by reference.

SECTION 2. INCORPORATION WITHIN ZONING CODE

Chapter 1, Article 3, of the Zoning Code of Sacramento County, Ordinance No. 1111, as amended, is hereby amended by adding thereto Section 23.01.352, which shall read as follows:

Section 23.01.352 – Planned Unit Development Ordinance No. 76-PD-4

Exhibit 1, described generally in this section and attached to this ordinance, is incorporated herein by reference and made a part of this ordinance to regulate the property described in Exhibit “A”. The exhibits are on file in the office of the Clerk of the Board of Supervisors and are a part of this ordinance as if fully set forth herein.

  • Exhibit 1: Development Plan

The following permitted uses and no others shall be permitted on the subject property described in Exhibit “A”:

  1. Storage of recreational vehicles. Recreational vehicles as used herein shall include but not be limited to campers, motorhomes, travel trailers, tent trailers, boats, boat trailers.
  2. No permanent buildings shall be constructed on the real property described in Exhibit “A”.

The owner/developer of the subject property shall erect an eight (8) foot fence on the north, east, and south perimeter of the subject property as that perimeter is shown on Exhibit “1”. At least six (6) feet of said fence shall be a chain link fence. The remaining two (2) feet of said fence may consist of barbed wire. No fencing shall be required on the west perimeter of the said property.

There shall be a planting area of at least three (3) feet wide located on the inside of the fence on the north, east, and south perimeter of the subject property. The planting area shall be planted with evergreen vines.

There shall be no more than twelve (12) pole lights located in the subject property in those places as shown on Exhibit “1”. Each pole light on the north and south perimeters of the subject property shall be equipped with a 180° anti-glare directional shield which shall be so situated so as to direct the light onto the subject property and away from the adjoining properties. Each pole light in approximately the middle of the subject property shall be equipped with a 360° anti-glare directional shield which shall direct light down onto the subject property. The distances between the pole lights shall be as shown on Exhibit “1”.

No signs shall be allowed on the subject property.

Access to the subject property shall be as shown on Exhibit “1”.

The subject property shall be covered with a gravel surface to the satisfaction of the Public Works Department.

During the public hearings on this ordinance, the Planning Commission and the Board of Supervisors determined that:

  1. The proposed development will carry out the intent of the General Plan.
  2. The proposed development is of sufficient size and is designed so as to provide a desirable environment within its own boundaries.
  3. The proposed development is compatible with the existing and proposed land uses in the surrounding area.
  4. The exceptions to the standard requirements of the Sacramento County Zoning Code, Ordinance No. 1111, as amended, are justified by the design of the development.
  5. There is adequate assurance that all public improvements will be installed at the scheduled times as required by the Public Works Department.
  6. There is adequate assurance that the development schedule will be met.
  7. The existing or proposed utility services are adequate for the uses and population densities proposed.

The variance provision of Article 1, Chapter 18 of the Sacramento County Zoning Code, Ordinance No. 1111, as amended, shall not apply to this ordinance.

Violation of the provisions of this ordinance or exhibits made part of this ordinance shall be deemed a violation of the Sacramento County Zoning Code, Ordinance No. 1111, as amended.

The North 381.61 feet of the South 726 feet of Lot 3112, H.J. Goethe Co’s Colony No. 31, as recorded in the office of the Recorder of Sacramento County in Book 6 of Maps, Map No. 31, excepting therefrom the easterly 163 feet.
