SECTION 1. PROPERTY REZONED
Section titled “SECTION 1. PROPERTY REZONED”Section 101-85 of the Zoning Code of Sacramento County, Ordinance No. 77-110 which incorporates Comprehensive Zoning Plan No. 29 is amended to change the real property described in Exhibit “A” on said Comprehensive Zoning Plan to the RM-2 (PD) Mobile Home Subdivision (Planned Development) Zone. Exhibit “A” is attached hereto and incorporated herein and made a part of this ordinance.
SECTION 2. INCORPORATION WITHIN ZONING CODE
Section titled “SECTION 2. INCORPORATION WITHIN ZONING CODE”Chapter 1, Article 4, Title I of the Zoning Code of Sacramento County, Ordinance No. 77-110, is hereby amended by adding thereto Section 101-360, which shall read as follows:
Section 101-360 – Planned Unit Development Ordinance 77-PD-9, commonly known as OX-BOW MARINA P.D.
SECTION 3. EXHIBITS INCORPORATED
Section titled “SECTION 3. EXHIBITS INCORPORATED”[AMENDED 09-03-1981]
Exhibit “2” described as the “development plan” is part of this ordinance and incorporated herein to regulate the property described in Exhibit “A”, which is a part of Ordinance No. 77-PD-9. Exhibit “2” supersedes Exhibit “1” which was adopted as part of Ordinance No. 77-PD-9. Said Exhibit “2” is on file in the office of the Clerk of the Board of Supervisors and is a part of this ordinance as if fully set forth herein.
SECTION 4. USES
Section titled “SECTION 4. USES”Those uses listed in Table I of the Sacramento County Zoning Code, Section 201.02, as permitted in the RM-2 zoning district shall be permitted in this zone, subject to the conditions specified in said table and provided in Section 201-04 of the Zoning Code.
SECTION 5. DESIGN OF PROJECT
Section titled “SECTION 5. DESIGN OF PROJECT”The location, configuration, and arrangement of lots, private streets, landscaped areas, and parking areas within the area described in Exhibit “A” shall be as shown on Exhibit “2”.
Parcels “C” and “D” as shown on Exhibit “2” shall be used only for a club house and recreation building as shown on said Exhibit “2” and for other outdoor sport or recreational uses. The location of the mobile homes on the lots shall generally comply with the typical plot plan shown on Exhibit “2”, shall occupy such front or side yard areas with the following setbacks:
- Front Yard: The mobile home shall not be located closer than 5 feet from the back of curb of the private street.
- Rear Yard: The mobile home shall not be located closer than 5 feet from the rear property line, and shall not extend beyond the shoulder of the levee.
- Side Yards: The mobile home shall not be located closer than 5 feet from any side lot line.
- Accessory Structures: Awnings, canopies, decks, sheds and other appurtenant accessory structures may be located within the buildable area of the lot and may encroach upon the mobile home side yards, provided that no such structure shall be located closer than 4 feet from any side lot line. No accessory structure or building, including but not limited to, docks, boat landing or docks shall be constructed on or to the water side of the shoulder of the berm on lots 1 through 71 inclusive as shown on Exhibit “2”.
SECTION 6. STREETS
Section titled “SECTION 6. STREETS”The right of access to each lot over and across the area designated as “Private Street and Parking” as shown on Exhibit “1”, shall be guaranteed to the owner of each lot by one of the following methods:
- Convey contemporaneously with the recording of the subdivision map the area shown as “Private Street and Parking” on Exhibit “1” to an association of owners of the subdivision lots. Said association shall be formed pursuant to provisions contained in the covenants, conditions and restrictions which shall be approved by the County Counsel’s office as provided in Section 8 of this ordinance.
- Convey a right of way easement to each purchaser of a lot in the subdivision over the area shown on Exhibit “1”.
The covenants, conditions and restrictions recorded by the subdivider shall provide that the private streets are to be maintained jointly by the owners of the lots and the owners of the “Future Commercial” order shown as “Lot A” on Exhibit “1”.
The widths of the private streets shall not be less than as shown on Exhibit “1”.
All private streets are to be named and dwelling units are to be identified by signs showing unit numbers and such names and unit numbers shall be placed at locations visible to emergency vehicles.
The minimum allowable thickness of the roadbed sections of private streets shall be as provided in Section 9.03 - 9.01 of the County Improvement Standards adopted by Resolution No. 73-495 of the Board of Supervisors of the County of Sacramento, and amendments thereto which establish the allowable thickness for 42 foot wide streets.
The parking stalls shall conform to the parking standards set forth in Chapter 30, Title III of the Zoning Code of the County of Sacramento, Ordinance No. 77-110, as amended.
SECTION 7. SUBDIVISION MAP
Section titled “SECTION 7. SUBDIVISION MAP”Developer and/or the owners shall record a subdivision map of the property described in Exhibit “A”. No site preparation or construction work of any kind shall be commenced until a tentative subdivision map has been submitted to and approved by the Planning Commission.
SECTION 8. APPROVAL OF COVENANTS AND RESTRICTIONS
Section titled “SECTION 8. APPROVAL OF COVENANTS AND RESTRICTIONS”The declaration of Covenants, Conditions, and Restrictions, which relate to the common area shall be approved by the County Counsel prior to the recording of the final subdivision map. The declaration of Covenants, Conditions and Restrictions shall provide that the same may not be amended without the concurring approval of Sacramento County. The documents shall also provide that the County of Sacramento shall be able to enforce the provisions of the documents which relate to the maintenance of the private roads and common areas.
The Covenants, Conditions and Restrictions shall provide for the maintenance of the common areas consistent with the provisions of this ordinance. They shall also provide that the lot owners or an association of the lot owners will not be responsible for the maintenance of lot “B” as shown on Exhibit “1”.
SECTION 9. VIOLATIONS
Section titled “SECTION 9. VIOLATIONS”Violation of the provisions of this ordinance or exhibits made part of this ordinance shall be deemed a violation of Sacramento County Zoning Code, Ordinance No. 77-110 as amended.

SECTION 11. FINDINGS
Section titled “SECTION 11. FINDINGS”During the public hearings on this ordinance the Planning Commission and the Board of Supervisors determined that:
- The proposed development will carry out the intent of the General Plan.
- The proposed development is of sufficient size and is designed so as to provide a desirable environment within its own boundaries.
- The proposed development is compatible with existing and proposed land uses in the surrounding area.
- Exceptions to the standard requirements of the Sacramento County Zoning Code, Ordinance No. 77-110, are justified by the design of the development.
- The arrangements of the dwellings and mixing of dwelling types is justified by larger and more usable open spaces.
- There is adequate assurances that all public improvements will be installed at the scheduled times as required by the Public Works Department.
- There is adequate assurance that the development schedule will be met.
- The existing or proposed utility services are adequate for the uses and population densities proposed.
