RESOLUTION VACATING A LIGHT AND AIR (BUILDING SETBACK) EASEMENT, PURSUANT TO SECTION 25367 OF THE GOVERNMENT CODE OF THE STATE OF CALIFORNIA
WHEREAS, on October 28th, 1994, the Board of Supervisors adopted Resolution No. 94-1456, a resolution of intention to vacate a light and air easement, ordered that the hearing on the proposed vacation be set for the 29th day of November, 1994, in the chambers of the Board of Supervisors, 700 H Street, Suite 1450, Sacramento, California; and
WHEREAS, a copy of Resolution No. 94-1456 has been posted on the directory in the lobby of the County Administration Building at least two weeks in advance of the hearing; and
WHEREAS, notice of the date, hour and place of hearing of the proposed vacation was published for at least two successive weeks prior to the hearing; and
WHEREAS, the hearing described above has been conducted, and this Board having heard and considered all oral, documentary and other evidence presented, hereby finds, determines and orders as follows:
BE IT RESOLVED by the Board of Supervisors of the County of Sacramento, a political subdivision of the State of California, that this Board hereby finds as follows:
- That vacation of the light and air easement would be consistent with, and not violative of, the General Plan and all elements and components thereof of the County of Sacramento;
- That the light and air easement is unnecessary for present or prospective public use because, Sacramento County Zoning Code imposes appropriate setback.
- The public interest will be served by the herein vacation.
SEE ATTACHED EXHIBIT A
BE IT FINALLY RESOLVED AND ORDERED that the Clerk of the Board of Supervisors shall cause a certified copy of this Resolution of Vacation, attested by the Clerk under seal, to be recorded in the office of the Recorder of the County of Sacramento.
On a motion by Supervisor T. JOHNSON, seconded by Supervisor DICKINSON, the foregoing Resolution was passed and adopted by the Board of Supervisors of the County of Sacramento, State of California, this 30th day of September, 1994, by the following vote, to wit:

EXCEPTING THEREFROM those maps lying within an incorporated city as of November 29, 1994.
ALSO, EXCEPTING THEREFROM the light and air easements shown adjacent to public street rights of way and Irrevocable Offers of Dedication that are within the rear yard area as defined by the Sacramento Zoning Code.
