SECTION 1. PROPERTY REZONED.
Section titled “SECTION 1. PROPERTY REZONED.”Section 23.01.181 and 23.01.187 of the Zoning Code of Sacramento County which incorporates Comprehensive Zoning Plans 372/200 and 372/212, are amended to change the real property shown on Exhibit “A” to the R-1-A (PD) (Planned Development) Zone. Exhibit “A” is attached hereto and incorporated herein and made a part ot this.ordinance.
SECTION 2. INCORPORATION WITHIN ZONING CODE.
Section titled “SECTION 2. INCORPORATION WITHIN ZONING CODE.”Chapter 1, Article 3, of the Zoning Code of Sacramento County, Ordinance No. llll, as amended, is hereby amended by adding thereto Section 23.01.355, which shall read as follows:
Section 23.01.355, Planned Unit Development Ordinance, No. 76-PD-7.
SECTION 3. EXHIBITS INCORPORATED.
Section titled “SECTION 3. EXHIBITS INCORPORATED.”Exhibit 1 described generally in this section and attached to this ordinance is incorporated herein and made a part of this ordinance to regulate the property described in Exhibit “A”. The Exhibit is on file in the office of the Clerk of the Board of Supervisors and is a part of this ordinance as if fully set forth herein.

SECTION 4. PERMITTED USES.
Section titled “SECTION 4. PERMITTED USES.”The following uses shall be permitted within the Planned Development:
- One (l) single family detached dwelling on each lot.
- Accessory buildings and uses.
- Foster homes not to exceed six (6) children including the children of the foster family.
- Signs. Signs shall be as permitted by Section 23.08.011(m), of the Sacramento County Zoning Code. Real Estate signs shall have a maximum area of five (5) square feet.
SECTION 5.
Section titled “SECTION 5.”All buildings, principal and accessory, shall be constructed with the yard requirements provided for in Section 23.08.014, of the Sacramento County Zoning Code except that such buildings shall be constructed within the areas shown and designated as “Residential Building Sites” constructed on Lots 141 through 143 inclusive as shown on Exhibit 1. Such ares shall be considered the “buildable area” or “buildable portions of the lot.” No building permits shall be issued for buildings constructed on Lots 41, 42, 100 through 115, inclusive, and 134, until a site plan for each of said lots has been approved by the Planning Department. Said site plan shall show the location of all trees to be retained or removed, and the location location of the proposed building. The Planning Department shall approve such site plan if the building location meets the yard requirements set forth above, and if such building location minimizes the need for removal of any trees on the site, consistent with maintaining the buildable area permitted for such site with the requirements for the R-1-A zone.
SECTION 6. GRADING.
Section titled “SECTION 6. GRADING.”Grading shall be permitted pursuant to the provisions of Chapter 16.44 of the Sacramento County Code; provided however, that Lots 71 through 81, inclusive, and Lots 101 through 115, inclusive, shall not be graded except for minor grading necessary to provide driveway and garage slabs, yard landscaping, and that required to insure adequate drainage. This requirement shall not preclude the installation of private swimming pools.
SECTION 7. STREETS.
Section titled “SECTION 7. STREETS.”All streets indicated on Exhibit “1” shall be offered for dedication as public streets and shall be constructed in conformance with the standards set forth in the County Improvement Standards adopted by Resolution No. 73-495, of the Board of Supervisors, except for lots 132, 133, and 134, which will be served by a private drive. The minimum allowable thickness of the roadbed sections of private drives shall be as provided in Section 9.03 - 9.01 of the County Improvement Standards adopted by Resolution 73-495 of the Board of Supervisors of the County of Sacramento, and amendments thereto which establish the allowable thickness for 42 foot wide streets.
SECTION 7. OPEN SPACE.
Section titled “SECTION 7. OPEN SPACE.”Lot “A” as shown on Exhibit “1” shall be granted to the Sunrise Recreation and Park District. Lot “B” shall be granted to the County of Sacramento. Such grants shall be for park purposes and shall satisfy the park dedication requirements of the County Code.
SECTION 8. FINDINGS.
Section titled “SECTION 8. FINDINGS.”During the public hearings on this ordinance, the Planning Commission and the Board of Supervisors determined that:
- The proposed development will carry out the intent of the general plan.
- The proposed development is of sufficient size and is designed so as to provide a desirable environment within its own boundaries.
- The proposed development is compatible with existing and proposed land uses in the surrounding area.
- The exceptions to the standard requirements of the Sacramento County Code, Ordinance No. 1111, as amended, are justified by the design of the development.
- The arrangements of dwellings is justified by a larger and more usable open space.
- There is adequate assurance that all public improvements will be installed at the scheduled times as required by the Public Works Department.
- There is adequate assurance that the development schedule will be met.
- The existing or proposed utility services are adequate for the uses and population densities proposed.
SECTION 9. VARIANCES.
Section titled “SECTION 9. VARIANCES.”The variance provision of Article 1, Chapter 18, of the Sacramento County Zoning Code, Ordinance No. 1111, as amended, shall not apply to this ordinance.
SECTION 1O. VIOLATIONS.
Section titled “SECTION 1O. VIOLATIONS.”The violation of the provisions of this ordinance or exhibits made part of this ordinance shall be deemed a violation of the Sacramento County Zoning Code, Ordinance No. 1111, as amended.
