SECTION 1.
Section titled “SECTION 1.”Exhibits “B”, “C”, “D”, “E”, “F”, “G”, “H”, “I”, “J”, “K”, and “L” attached hereto are incorporated into and made a part of this Ordinance for all purposes. The exhibits are on file in the Office of the Clerk of the Board of Supervisors and are part of this Ordinance as if fully set forth herein.
SECTION 2.
Section titled “SECTION 2.”Section 2 of Ordinance No. 534, as amended, is hereby amended to change the Zoning Classification of the real property described in Exhibit “A” attached hereto from R‑2A (Precise Plan) Multiple Family Residential to R‑2A (PD), subject to the provisions of this Ordinance.
SECTION 3.
Section titled “SECTION 3.”During the public hearing on this Ordinance the Board of Supervisors made the following findings:
- That the proposed development will carry out the intent of the General Plan.
- That the proposed development is of sufficient size and is designed so as to provide a desirable environment within its own boundaries.
- That the proposed development is compatible with existing and proposed land uses in the surrounding area.
- That exceptions to the standard requirements of the Basic Zoning Ordinance are justified by the design of the development.
- That the arrangement of dwellings and mixing of dwelling types is justified by larger and more usable open spaces.
- That there is adequate assurance that all public improvements will be installed at the scheduled times as required by the Public Works Department.
- That there is adequate assurance that the development schedule will be met.
- That the existing or proposed utility services are adequate for the uses and population densities proposed.
SECTION 4.
Section titled “SECTION 4.”The use of the property described in Exhibit “A” shall be related to apartment houses and incidental and subordinate accessory uses thereto. The apartment houses shall substantially conform to the units shown on Exhibits “B” and “D”.
SECTION 5.
Section titled “SECTION 5.”The location of apartment units, uncovered parking spaces, covered parking, recreational facilities, streets, ingress and egress to the property, and landscaping shall substantially conform to the site plan described in Exhibit “c”.
SECTION 6.
Section titled “SECTION 6.”The architectural character and the elevations of the apartment units shall substantially conform to the units described in Exhibits “B” and “D”.
SECTION 7.
Section titled “SECTION 7.”Floor plans for the various types of apartment units shall substantially conform to the plans described in Exhibits “E”, “F”, “G”, “H”, “I”, “J”, “K” and “L”.
SECTION 8.
Section titled “SECTION 8.”It is intended to permit flexibility in the arrangement and types of apartments within the clusters of apartment units described in Exhibit “C”. For the purposes of this Ordinance and to carry out this intent the developer may construct any of the units described in Exhibits “E” through “L”, inclusive, provided that:
- The number of clusters of units remains the same as shown on Exhibit "C".
- The number of units within each cluster remains the same as shown on Exhibit "C".
- The percentage of parking spaces, internal roads, apartment house units, and landscaping shall conform to the "coverage" shown on Exhibit "C", provided however, the number of covered parking spaces shall not be less than the number of spaces covered on the site plan of Exhibit "C".
- The number of square feet of apartment house floor space shall not exceed the product of 1055 square feet times the number of units within each cluster and within the development as a whole.
SECTION 9.
Section titled “SECTION 9.”The variance provision of Section 21 of said Ordinance No. 534, as amended, shall not apply to this Ordinance.
SECTION 10.
Section titled “SECTION 10.”A masonry wall, six feet (6’) in height shall be constructed along the western and southern property lines as described in the site plan of Exhibit “C”.
SECTION 11.
Section titled “SECTION 11.”Building permits shall not be issued for construction until final development plans and construction plans have been submitted to and approved by the Planning Department and Department of Public Works of the County of Sacramento. Plans and Drawings shall be submitted for the entire project on or before July 31, 1971.
SECTION 12.
Section titled “SECTION 12.”Construction for the entire project shall be completed on or before July 13, 1974. Construction includes the completion of all apartment units, roads, parking spaces. and the installation of landscaping.
SECTION 13.
Section titled “SECTION 13.”Violation of the provisions of this Ordinance or Exhibits made part of this Ordinance shall be deemed a violation of the Basic Zoning Ordinance, Ordinance No. 534, as amended.
SECTION 14.
Section titled “SECTION 14.”Resolution No. 63‑564 adopted by the Board of Supervisors on April 24, 1963 to implement a precise plan for the property described in Exhibit “A” is superseded by the provisions of this Ordinance.

Rancho Del Paso” filed for record in the office of the Recorder of Sacramento County, May 15. 1964, in Book 22 of Surveys, Page No. 2, described as follows:
Beginning at the Southeast corner of the parcel of land shown on said Record of Survey located in the center line of Watt Avenue: thence along the East line thereof and said center line, North 01º 46’ 30” West 317.94 feet; thence, South 89º 02’ 30” West 156.06 feet thence North 00º 57’ 30” West 18.33 feet; thence, South 89º 02’ 30” West 504.20 feet to the West line of the parcel of land shown on said Record of Survey; thence along said West line South 01º 46’ 30” East 336.28 feet, to the Southwest corner thereof. thence along the South line of said parcel of land, North 89º 02’ 30” East 660.00 feet to the point of beginning.

Beginning at a point in the East line of the parcel of land shown on said Record of Survey and the center line of WAtt Avenue. located North 01º 46’ 30” West 317.94 feet from the Southeast corner thereof; thence along said East line and said center line. 01º 46’ 30” West 45.57 feet, to a point in the center line of the storm drainage easement described in Boook 2333 of Official Records, page 529, located North 01º 46’ 30” West 2376.85 feet from the Southeast corner of said Section 29; thence along the center line of said easement, North 56º 46’ 30” West 284.82 feet, North 68º 33’ 57” West 148.45 feet.
