SECTION 1. INCORPORATION WITHIN ZONING CODE.
Section titled “SECTION 1. INCORPORATION WITHIN ZONING CODE.”Section 101-244, in Chapter 1, Article 4, of hte Zoning Code of Sacramento County, Ordinance No. 83-10, as amended, is hereby amended to read:
101-244. Planned Unit Development Ordinance No. 76-PD-2A, commonly known as “Kenneth Hills Planned Development” as amended in 1987.
SECTION 2. EXHIBITS INCORPORATED.
Section titled “SECTION 2. EXHIBITS INCORPORATED.”Exhibit “A” described generally in this Section and attached to this ordinance is incorporated herein and made a part of this ordinance to regulate the property described in Exhibit “A”. The exhibits are on file in the Office of the Clerk of the Board of Supervisors and are a part of this ordinance as if fully set forth herein.

SECTION 3. PERMITTED USES.
Section titled “SECTION 3. PERMITTED USES.”The following uses shall be permitted within the Planned Development:
- One (1) single family detached dwelling on each lot
- Accessory structures:
- Accessory structures buildings as used in this ordinance shall mean all those structures appurtenant to a permitted use which are incidental to, and subordinate to the principal use of the premises. Such accessory structures shall comply with the following setback requirements:
- Front yard. As shown on Exhibit "1" of Ordinance No. 76-PD-2A.
- Rear yard. Three (3) feet.
- Side yard. Three (3) feet.
- Side street yard. As shown on Exhibit "1" of Ordinance No. 76-PD-2A.
- Distance from principal buildings. Six (6) feet.
- Accessory uses:
- Accessory uses as shown in this ordinance shall mean all those uses customarily incidental to and subordinate to the principal use of the premises.
- Signs.
- Signs shall be as permitted by Sacramento County Zoning Code. Real Estate signs shall have a maximum area of five (5) square feet.
- No other uses are permitted except as specifically allowed herein.
SECTION 4. DEVELOPMENT REQUIREMENTS.
Section titled “SECTION 4. DEVELOPMENT REQUIREMENTS.”The front yard, side street yard, and side yard requirements for all buildings principal shall be as designated on Exhibit “1”. For Lots 9, 11, 19, and 26, there shall be two building envelopes. These building envelopes shall be alternate building envelopes, and each shall consist of a different set of front yard, side street yard, and side yard requirements as shown on Exhibit “1”. The alternate envelopes are identified on Exhibit “1” for said lots as alternates 1 and 2. The selection of one alternate set of such yard requirements by the developer in the location of any building on such lots shall result in excluding the use of the other set of yard requirements.
SECTION 5. TREES.
Section titled “SECTION 5. TREES.”The design, configuration and layout of all buildings shall be accomplished so as to protect the trees shaded in green as shown on Exhibit “1”. Those trees marked with a red “X” on said exhibit may be removed.
SECTION 6. GRADING.
Section titled “SECTION 6. GRADING.”Grading of individual lots is not permitted except for minor grading necessary to provide driveway and garage slabs, yard grading, streets, and that required to provide adequate drainage. When grading of individual lots is done as authorized herein, such grading shall be done in a manner consistent with the grading plan attached hereto as Exhibit “2”. Such cutting of individual lots shall not exceed one-half foot and the material so cut may be used to fill those areas to be filled as shown on Exhibit “2”. This section shall not preclude the installation of private swimming pools. Where the developer, builder, or owner desires to construct buildings whose design necessitates excavation otherwise prohibited by this section the developer, builder, or owner shall submit grading plans to the Planning Director for his approval. The Planning Director shall approve such plans if he finds that such excavation or grading is reasonably necessary for the construction of said buildings.
SECTION 7. STREETS.
Section titled “SECTION 7. STREETS.”All streets indicated on Exhibit “1” shall be offered for dedication as public streets and shall be constructed in conformance with the standards set forth in the County Improvement Standards adopted by Resolution No. 73-495, of the Board of Supervisors, for Class “B” streets as defined therein.
SECTION 8. REQUIRED FINDINGS.
Section titled “SECTION 8. REQUIRED FINDINGS.”During the public hearings on this ordinance, the Planning Commission and the Board of Supervisors determined that:
- The proposed development will carry out the intent of the general plan.
- The proposed development is of sufficient size and is designed so as to provide a desirable environment within its own boundaries.
- The proposed development is compatible with the existing and proposed land uses in the surrounding area.
- The exceptions to the standard requirements of the Sacramento County Code, Ordinance No. 1111, as amended, are justified by the design of the development.
- The arrangements of dwellings is justified by a larger and more usable open space.
- There is adequate assurance that all public improvements will be installed at the scheduled times as required by the Public Works Department.
- There is adequate assurance that the development schedule will be met.
- The existing or proposed utility services are adequate for the uses and population densities proposed.
SECTION 9.
Section titled “SECTION 9.”This ordinance was introduced and the title thereof read at the regular meeting of the Board of Supervisors on March 10, 1976, and on March 10, 1976, further reading was waived by unanimous vote of the Supervisors present.
EXHIBIT A. LEGAL DESCRIPTION
Section titled “EXHIBIT A. LEGAL DESCRIPTION”All that certain real property situate, lying -and being in the County of Sacramento, State of California, particularly described as follows:
The East one-half of Lot 2 Ralph Skinner 1 Tract, except the North 18.64 feet of the East 178.42 feet measured along the East line and Lot 3 Ralph Skinner Tract, recorded in the office of the County Recorder of Sacramento County on June 1, 1917 in Book 15 of Maps, Page 39.
EXCEPTING THEREFROM the North 180 feet of the West 200 feet of said Lot 3.
