Hillsvilla Planned Development Ordinance

SECTION 1.
Section titled “SECTION 1.”The provisions of this Ordinance shall apply to that certain planned unit development commonly known as Hillsvilla Townhouse.
SECTION 2.
Section titled “SECTION 2.”Paragraph 49 of Subsection B of Section 2 of Ordinance No. 534, as amended, which incorporates Comprehensive Zoning Plan Unit No. 364/176, is amended to change the real property described in Exhibit 1 to the R-2A (PD) Multiple Family Residential Zone (Planned Development), and said real property shall be subject to all of the provisions set forth in this Ordinance. Exhibits “A” and “B”, attached hereto, are incorporated and made a part of this Ordinance to regulate the property described in Exhibit 1. The exhibits are on file in the office of the Clerk of the Board of Supervisors of Sacramento County and are part of this Ordinance as if fully set forth herein. The exhibits are generally described as:
EXHIBIT “A”. Site Plan for Hillsvilla Townhouse (map shows phasing plan and grading plan also).
EXHIBIT “B”. Book of Floor Plans and Exterior Elevations.
SECTION 3.
Section titled “SECTION 3.”Except as provided in Section 4, the arrangement and location of the public roads, private driveways, dwelling units, recreation buildings, swimming pools and private walkways shall conform to Exhibits “A” and “B”.
SECTION 4.
Section titled “SECTION 4.”Minor deviations in the location and number of public roads, private driveways, dwelling units, recreational facilities, child care centers, and private walkways shall be permitted if approved by the Zoning Administrator. The Board of Supervisors hereby authorizes the Zoning Administrator to make such minor changes and in so authorizing, has determined that such minor changes do not constitute an amendment to the Basic Zoning Ordinance or to the provisions of this Ordinance. In no event shall the Zoning Administrator permit an increase in the number of dwelling units or a decrease in the amount of open space as shown on Exhibit “B”.
SECTION 5.
Section titled “SECTION 5.”Not more than two hundred sixty-two (262) dwelling units shall be constructed to the floor plans and elevation shown on Exhibit “B”. Dwelling units identified as Types A, B, C, D, E, and F shall be constructed pursuant to the arrangement of such dwelling units set forth in Exhibit “A”.
SECTION 6.
Section titled “SECTION 6.”The construction of the swimming pools and recreation buildings shown on Exhibits “A” and “B” shall commence only after approval of the plans for said swimming pools and recreation buildings by the Planning Department.
SECTION 7.
Section titled “SECTION 7.”Development shall commence for Phase 1 within 12 months. The sequence of construction for the balance of the property described in Exhibit 1 shall be as shown on the Site Plan identified as Exhibit “A”.
SECTION 8.
Section titled “SECTION 8.”Landscaping shall be generally as is described on Exhibit “A”. Developers shall submit to the Planning Department a landscaping plan which conforms in general to the landscaping shown on Exhibit “A”. Said plan shall be approved by the Planning Department before issuance of building permits for any dwelling unit.
SECTION 9.
Section titled “SECTION 9.”Covered and uncovered parking shall conform to the arrangement shown on Exhibit “A”. Parking stalls shall be identified to correspond with dwelling units except guest parking which shall be identified for that purpose. Parking areas shall not be converted to other uses. The parking and/or storage of commercial, industrial or agricultural motor vehicles or trailers rated more than one ton capacity is expressly prohibited. All boats, trailers, and recreational motor vehicles and bodies stored adjacent to the residential areas shall be stored in parking stalls.
SECTION 10.
Section titled “SECTION 10.”Developer shall be permitted to maintain sales offices in one or more of the dwelling units and to have model homes to show the various styles of dwelling units. Dwelling units used for sales offices or model homes or both shall be restored so as to be the same as the other dwelling units at the close of any sales program. Dwelling units shall not be used for home occupations.
SECTION 11.
Section titled “SECTION 11.”After a dwelling unit has been sold, no sign shall be erected or placed thereon except that not more than one for sale, lease or rent sign may be displayed upon such dwelling unit by the owner thereof during the period such owner is selling, leasing or renting said dwelling, provided, however, that such sign shall not be larger than 18 inches by 24 inches. No advertising signs shall be erected or placed in the common area.
SECTION 12.
Section titled “SECTION 12.”All utilities shall be underground.
SECTION 13.
Section titled “SECTION 13.”The Homeowners’ Association established to maintain the common area shall maintain the landscaping shown in the planting areas on McCloud Drive. The developer shall be responsible for the initial planting of said planting strips on McCloud Drive.
SECTION 14.
Section titled “SECTION 14.”Developer shall, in conformity with Section 3:
- File a subdivision map.
- Provide sidewalks on one side and Class B street improvements on the other side of Villa Drive and McCloud Drive.
- Construct and maintain private driveways and roadways to standards to be approved by the Public Works Department, County of Sacramento.
- Secure approval of the plan from the Citrus Heights Fire District as to the circulation within the development.
- Provide public sanitary sewer facilities and public water supply facilities including provision of a well site as may be required by the Northridge Water District.
- Provide drainage casements and install drainage facilities to the satisfaction of the Public Works Department, County of Sacramento, including the payment of any fee required by Ordinance 1 of the County Water Agency.
SECTION 15.
Section titled “SECTION 15.”Violation of the provisions of this Ordinance and exhibits made part of this Ordinance shall be deemed a violation of the Basic Zoning Ordinance, Ordinance No. 534, as amended.
SECTION 16.
Section titled “SECTION 16.”The variance provisions of Section 21 of Ordinance No. 534, as amended, shall not apply to this Ordinance.
SECTION 17.
Section titled “SECTION 17.”The Articles of Incorporation and By-laws of the Homeowners’ Association and the Declaration of Covenants, Conditions and Restrictions which relate to the common area shall be approved by the County Counsel prior to the issuance of any building permits for any construction on the property described in Exhibit 1. The Declaration of Covenants, Conditions and Restrictions, the Articles of Incorporation and the By-laws shall provide that the same may not be amended without the concurring approval of Sacramento County. The documents shall also provide that the County of Sacramento shall be able to enforce the provisions of the documents which relate to the maintenance of the common open space.
SECTION 18.
Section titled “SECTION 18.”During the public hearings on this Ordinance the Planning Commission and the Board of Supervisors determined that:
- The proposed development will carry out the intent of the General Plan.
- The proposed development is of sufficient size and is designed so as to provide a desirable environment within its own boundaries.
- The proposed development is compatible with existing and proposed land uses in the surrounding area.
- Exceptions to the standard requirements of the Basic Zoning Ordinance are justified by the design of the development.
- The arrangement of dwellings and mixing of dwelling types is justified by larger and more usable open spaces.
- There is adequate assurance that all public improvements will be installed at the scheduled times as required by the Public Works Department.
- There is adequate assurance that the development schedule will be met.
- The existing or proposed utility services are adequate for the uses and population densities proposed.
